Welcome to Papaking (www.papaking.fun). These Terms of Service ("Terms") are a binding legal agreement between you ("you", "your") and Papaking ("we", "us", "our"), a United States (California) e-commerce retailer of premium vapor products, disposable vapes, pod systems, and lab-tested e-liquids. By browsing, accessing, or placing an order through our website, you confirm that you have read, understood, and agree to be bound by these Terms, and — critically — that you are at least 21 years of age.
All products offered on www.papaking.fun are restricted exclusively to adults 21 years of age or older. You represent and warrant that: (a) you are 21 years of age or older; (b) the identity and age-verification documentation you provide during checkout or on demand is genuine, accurate, and not misleading; (c) any person for whom you purchase products is also 21 years of age or older and legally permitted to purchase, possess, and use nicotine-containing products under applicable local, state, and federal law. We reserve the right to refuse any order, cancel any shipment, and permanently terminate any account, without refund, at our sole discretion if we have reasonable grounds to believe the purchaser is under 21 or has provided false age or identity information.
WARNING — Nicotine is an addictive chemical. Our products are not smoking-cessation devices and have not been evaluated by the US Food and Drug Administration (FDA) as such. They are not intended to diagnose, treat, cure, mitigate, or prevent any disease, condition, or addiction. If you are pregnant, nursing, have heart disease, high blood pressure, diabetes, take asthma or depression medication, or are allergic to nicotine, propylene glycol, vegetable glycerin, or natural or artificial flavorings, do not use these products. Consult a licensed physician before use.
You agree that you will not resell, distribute, or deliver any Papaking product to any jurisdiction where such possession, sale, or use is unlawful, including — without limitation — any US state, municipality, or country that has banned the retail sale of flavored or disposable nicotine vapor products. It is your sole responsibility to ascertain and comply with all applicable laws, taxes, and regulations of the jurisdiction in which you receive, possess, and use the products. You will indemnify, defend, and hold harmless Papaking, its officers, employees, agents, and affiliates from and against any and all claims, damages, penalties, fines, losses, costs, and expenses (including reasonable attorneys' fees) arising from any violation of law by you in connection with your use of, or dealings in, Papaking products.
You are responsible for maintaining the confidentiality of your account credentials (email, password) and for all activities that occur under your account. All orders are subject to acceptance by us; we may, without liability, decline, cancel, limit the quantity of, or refuse to process any order for any lawful reason, including but not limited to suspected fraud, inventory error, pricing typographical error, or failure to pass age / identity verification. Prices are listed in US Dollars (USD). We reserve the right to change prices at any time without notice. Payment must be received in full prior to shipment. We accept Visa, Mastercard, American Express, Discover, Shop Pay, PayPal, Apple Pay, and Google Pay via PCI-DSS compliant payment processors.
Shipping terms, carriers, and delivery windows are set forth in our Shipping Policy (www.papaking.fun/pages/shipping-policy) and incorporated herein by reference. Title and risk of loss or damage to products pass to you upon delivery to the carrier at our facility. Adult signature (21+) is required for delivery at our sole option or where required by state law.
All returns and refunds are governed by our Returns & Refunds Policy (www.papaking.fun/pages/refund-policy), which is incorporated herein by reference. Because vapor products are regulated consumer goods, sealed and unused product returns are accepted only within 14 calendar days of delivery in accordance with that policy. Opened or used products are strictly non-refundable for reasons of health, safety, hygiene, and regulatory compliance.
Papaking warrants to the original retail purchaser that any hardware product (vape devices, kits, pod systems) shall be free from material defects in workmanship and materials under normal consumer use for a period of 30 days from the date of delivery. Our sole obligation, and your exclusive remedy, under this limited warranty shall be — at our option — repair or replacement of the defective hardware unit. This limited warranty does not cover accidental damage, misuse, abuse, modification, water damage, normal wear and tear, unauthorized repair, or any use that violates applicable law or product care instructions. Consumables (disposable vapes, prefilled pods, e-liquid bottles, coils, cotton, batteries) carry no warranty beyond DOA coverage for 7 days.
EXCEPT FOR THE EXPRESS LIMITED WARRANTY ABOVE, ALL PAPAKING PRODUCTS AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING — WITHOUT LIMITATION — THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PAPAKING MAKES NO WARRANTY THAT THE SITE OR PRODUCTS WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PAPAKING, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE OR PRODUCTS, EVEN IF PAPAKING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL PAPAKING'S TOTAL AGGREGATE LIABILITY UNDER OR RELATING TO THESE TERMS EXCEED THE AMOUNT YOU ACTUALLY PAID TO PAPAKING IN THE TWELVE (12) CALENDAR MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
Papaking, the Papaking logo, product names, taglines, graphic marks, custom icons, site design, photography, video content, and copy featured on our Service are the exclusive property of Papaking or its licensors and are protected by US and international copyright, trademark, trade dress, and other intellectual property laws. Any reproduction, redistribution, modification, framing, scraping, commercial exploitation, or use of Papaking intellectual property without our prior written permission is strictly prohibited.
If you submit reviews, photos, comments, or suggestions to us, you grant Papaking a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, display, perform, modify, distribute, and create derivative works from such content in any medium. You agree not to use the Service to: (a) violate any law, statute, ordinance, or regulation; (b) impersonate any person or entity; (c) upload or transmit viruses, malware, or code of a destructive nature; (d) engage in data mining, scraping, crawling, or automated access; (e) interfere with security features or circumvent age-verification controls; or (f) advocate the use of nicotine products by minors.
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the internal laws of the State of California, United States of America, without regard to its conflict of laws principles. You and Papaking each irrevocably submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, for the resolution of any dispute or claim. Any cause of action you may have with respect to the Service or these Terms must be commenced within one (1) year after the claim arises.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms (together with our Privacy Policy, Shipping Policy, Returns & Refunds Policy, and Age Verification Policy, each of which is incorporated herein by reference) constitute the entire agreement between you and Papaking concerning the subject matter hereof and supersede all prior or contemporaneous understandings.
